Rule 17.1 tells us, if you overtake another boat and establish a leeward overlap, you can’t luff that boat by sailing above your proper course. The windward boat still has to keep clear of your boat, but you must give her enough room to do so.

In this graphic, the 3 boats rounding the mark did not establish the overlap from behind, so the leeward boats are free to luff above their proper course. But notice, while the Green and Red boats are duking it out with a luffing duel, the Yellow boat beats them to the mark.
